Terms of Service

1. Agreement

DEEPWELL is a product released by ZeroClickDev. These Terms of Service (“Terms”) govern your use of the DEEPWELL website, connected game services, Early Access builds, downloads, Web Direct purchase, and LUMINOSITY packs. By using the service or completing a purchase, you agree to these Terms with ZeroClickDev and acknowledge the Privacy Policy. If you do not agree, do not use or purchase DEEPWELL.

2. Eligibility and accounts

• You must be at least 13 to use connected DEEPWELL services.
• If you are below the age of legal majority where you live, a parent or guardian must approve your use and any purchase.
• Give accurate information, keep access links and account credentials private, and notify us if you suspect unauthorized use.
• Access and delivery are tied to the email used for the request and purchase. You may not sell, transfer, or share an account or private download link.

3. Early Access

DEEPWELL is pre-release software. Features, cards, balance, saves, online services, supported platforms, system requirements, and release plans may change. The game may have bugs, interruptions, resets, or incomplete features. We may update, suspend, or discontinue Early Access features when reasonably necessary, but this does not limit rights that law gives you for a paid purchase.

4. Web Direct purchase

• When checkout is open, Web Direct is offered as a one-time $15 purchase, plus any tax shown at checkout.
• Stripe handles payment. DEEPWELL does not store your full payment-card number.
• A confirmed purchase grants the purchaser a personal license to the included Web and Windows direct editions made available through the delivery flow.
• The current Windows edition is an unsigned 64-bit portable ZIP. It checks for a newer release at startup, but installation is manual: download the replacement ZIP, close the game, extract it, and replace the previous extracted folder.
• Steam, App Store, console, or other storefront editions are separate products with their own prices, accounts, rules, and platform support.
• There is no recurring subscription charge for Web Direct.

If payment is confirmed but access is not delivered, or the delivered build cannot be used as described, contact us. We will investigate and provide support, replacement access, or a refund as appropriate. Nothing in these Terms limits mandatory refund, cancellation, warranty, or consumer-protection rights where you live.

5. LUMINOSITY packs

• In the United States storefront, one LUMINOSITY pack is a separate $19.00 consumable In-App Purchase through Apple. Apple shows the final price and applicable tax and processes the payment. It is not a subscription.
• Each completed pack delivers exactly three personalized Rare playable cards to the purchasing DEEPWELL account. The account owns the in-game entitlement, and fulfillment binds the cards to the selected save slot shown at checkout. Recovery preserves that same entitlement without duplication and may rebind it to another active durable slot if the original local slot is unavailable; it never creates copies in multiple save slots. The purchase does not transfer DEEPWELL intellectual-property ownership.
• An account may purchase no more than three LUMINOSITY packs during its lifetime. The server enforces the product, price, account ownership, transaction, and limit. A refund, account deletion, email change, or later account recreation does not create another purchase slot, except where applicable law requires otherwise.
• One of each pack’s three delivered cards is randomly selected with an equal 1-in-3 chance as a candidate for shared-game review. Candidate status does not guarantee permanent inclusion. Final inclusion depends on originality, balance, safety, and fit. The $19 purchases the three cards—not inclusion in the shared game.
• If a candidate is approved, ZeroClickDev may adapt and permanently include that card in the shared game under the player-content license below. Inclusion is not a contest, prize, cash award, royalty, or promise of compensation.
• Apple handles payment authorization and refund requests under its rules and applicable law. After a verified refund, DEEPWELL may remove the refunded pack’s cards and related entitlement. A verified refund reversal restores the same entitlement; it does not create a new pack or purchase slot.

If Apple confirms a purchase but delivery is interrupted, reopen the in-game STORE while signed into the same DEEPWELL account. The same verified transaction will resume without a second charge or duplicate cards. Do not purchase again to recover a pending pack. Contact us if recovery does not complete. Nothing in these Terms limits mandatory refund, cancellation, warranty, or consumer-protection rights where you live.

6. License

Subject to these Terms and any required payment, ZeroClickDev grants you a limited, non-exclusive, non-transferable, revocable license to install and play your copy for personal, non-commercial use. DEEPWELL and its art, code, music, writing, characters, marks, and other content remain owned by their respective rights holders. No ownership is transferred to you.

7. Acceptable use

You may not:

• Use DEEPWELL unlawfully or to harass, threaten, exploit, or harm anyone.
• Bypass access, purchase, download, security, or rate-limit controls.
• Distribute private builds, purchase links, credentials, or protected download URLs.
• Cheat in connected modes, manipulate service data, introduce malicious code, or disrupt infrastructure.
• Scrape, resell, or commercially exploit the service except as allowed by law or written permission.
• Infringe intellectual-property, privacy, publicity, or other rights.

These restrictions do not prohibit conduct that applicable law expressly allows despite a contractual restriction.

8. Feedback and player content

You keep ownership of content you submit. You give DEEPWELL a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, modify, display, distribute, and use that content as needed to operate, support, secure, and improve the game, including to review, adapt, and include an approved LUMINOSITY candidate in the shared game. If you send ideas or suggestions, we may use them without payment or obligation to you. Do not submit content you lack the right to share.

9. Suspension and termination

You may stop using DEEPWELL at any time. We may suspend or terminate connected access for a material breach, fraud, abuse, security risk, or legal requirement. When practical, we will provide notice and a reasonable opportunity to correct the issue. Terms that by their nature should survive termination—including ownership, payment records, disclaimers, and limits of liability—will survive.

10. Disclaimers

To the maximum extent permitted by law, DEEPWELL and its Early Access services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some places do not allow certain disclaimers, so they may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, ZeroClickDev will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or opportunities arising from the service. Our total liability for claims relating to a paid Web Direct copy or LUMINOSITY pack will not exceed the amount you paid for the purchase at issue. These limits do not apply where prohibited, including to liability that cannot legally be limited.

12. Governing law

California law governs these Terms without regard to conflict-of-law principles. Courts located in California will have jurisdiction, except where the law where you live gives you a mandatory right to bring a claim elsewhere or provides other non-waivable protections.

13. Changes and contact

We may update these Terms as DEEPWELL changes. We will post the revision, update the effective date, and give additional notice when required. Material changes apply prospectively. If any provision is unenforceable, the rest remains in effect. Questions can be sent to trent@zeroclickdev.ai.
